1. Acceptance of Terms

Welcome to CaptionSense. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

CaptionSense provides an AI-powered tool that generates emotion-aware captions for social media images across multiple platforms and languages with a privacy-first approach.

2. Credit System

CaptionSense operates on a credit-based payment model:

• 1 Credit = 1 Caption Generation
• Free users receive a limited number of trial credits
• Additional credits can be purchased in packages
• Credits never expire
• Previously generated captions can be accessed without using additional credits (within 24 hours)

Credit packages and pricing are displayed on our Pricing page. Prices may be updated from time to time, but changes will not affect credits already purchased.

3. User Accounts

To use CaptionSense, you must create an account using either Google authentication or our Email Magic Link system. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to:

• Provide accurate and complete information when creating your account
• Update your information as necessary to keep it current
• Notify us immediately of any unauthorized use of your account
• Use the service only for lawful purposes

4. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using CaptionSense, you agree to our Privacy Policy, including our Zero Image Storage approach.

5. Acceptable Use

When using CaptionSense, you agree not to:

• Use the service for any illegal purpose
• Upload, process, or generate captions for inappropriate, offensive, or harmful images
• Attempt to generate captions that promote hate speech, discrimination, or violence
• Infringe on intellectual property rights of others
• Attempt to bypass, disable, or interfere with our security features
• Use automated scripts or bots to access the service
• Attempt to reverse-engineer our algorithms or service
• Resell or redistribute our service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

6.1 Our Intellectual Property

CaptionSense, including its logo, design, code, and algorithms, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our explicit permission.

6.2 Your Content

You retain all rights to the images you process through CaptionSense. We do not store your images on our servers. The captions generated by our service are for your use and you are free to use them as you wish, subject to our Terms of Service.

By using our service, you grant us a limited license to process your images client-side for the purpose of generating captions. This license does not give us any ownership rights to your content.

7. Payment and Refunds

All payments for credits are processed through Stripe. By purchasing credits, you agree to Stripe's terms of service.

Regarding our credit system and refund policy:

• Refunds may take 5-10 business days to appear on your statement
• Stripe's fees for the original payment won't be returned, but there are no additional fees for the refund
• Partial refunds are available and will be calculated based on unused credits
• The refund amount will be proportional to the remaining unused credits in your account
• If there is a technical issue preventing the delivery of credits after payment, please contact our support team immediately
• We reserve the right to modify our credit packages and pricing at any time

8. Disclaimer of Warranties

CaptionSense is provided "as is" and "as available" without any warranties, expressed or implied. We do not guarantee that:

• The service will be uninterrupted or error-free
• All generated captions will be perfect or appropriate for your needs
• The service will be compatible with all devices or platforms
• Any errors or issues will be corrected

While we strive to provide high-quality captions, the AI-generated content may require review and editing by you before use.

9. Limitation of Liability

To the maximum extent permitted by law, CaptionSense and its affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our service.

Our total liability for any claims relating to these Terms or your use of the service shall not exceed the amount you paid to CaptionSense in the six months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination:

• You will lose access to your account and any unused credits
• These Terms will continue to apply to any past use of the service
• We may delete your account data according to our Privacy Policy

You may also terminate your account at any time by contacting us. Termination will not entitle you to a refund for unused credits.

11. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of significant changes through email or by posting a notice on our website. Your continued use of CaptionSense after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Thailand.
